Successful Cases

Successful Cases in Nassau, Suffolk and Queens Counties

  1. I did this: A client was charged with Sexual Misconduct in Suffolk County.  He faced imprisonment, loss of employment, and the Stigma of having to register as a sexual offender.  After a 7 day trial the jury returned a “not guilty” verdict.  I proved that the alleged female victim was intoxicated on the night in question, brought my client to a secluded area, engaged in consensual intercourse and failed to timely report the event to the police for days after the occurrence.
  2. I did this: My client, age 16, was charged with murder in Queens County.  The prosecution’s case was based solely on his confession.  The murder occurred in a fight between rival gang members with over 100 individuals present. A hearing was conducted where I proved that the confession was coerced and that my client, who spoke Spanish, did not fully comprehend what he confessed to.  He was detained for over 18 hours, given little to eat or drink, was unable to speak to a family member or hire an attorney and claimed that he was not involved in any murder.  He would have faced 25 years in jail.  After his confession was “thrown out”  my client was released from custody.
  3. I did this: My client moved to Virginia in 2002.  He left New York State with a warrant for his arrest for two DWI’s.  He wanted to clear the warrant without serving any jail time for an incident which happened 20 years ago.  We appeared in the Nassau County Court, vacated the warrant and arranged for him to pay a fine and avoid Jail Time.  We showed that his physical disabilities prevented him from attending to this matter 20 years ago.  He is an elderly individual who wanted to “clear his name” –  Today he is now eligible to get a driver’s license in Virginia.
  4. I did this: My client is employed as an EMS worker who was arrested and charged with a misdemeanor DWI.  If convicted he would certainly lose his job which involved assisting members of the public every day.  His blood alcohol reading was not very high and if we could show it was below the legal limit he would be able to conclude the case with Driving while Impaired (not a crime) instead of Driving While Intoxicated.  We went to trial in the Nassau County District Court where we employed the services of an experienced College Professor of Chemistry.  We demonstrated that the breath machine was not properly used and the jury ultimately returned a verdict to the lesser charge.  My client remains gainfully employed as an EMT worker.
  5. I did this: My client was initially represented by the Legal Aid Society and plead guilty to Driving While Intoxicated.  This occurred in Nassau County and he was going to be sentenced to Jail Time for his conduct.  I took over the case from the Legal Aid lawyer.  My client could not serve jail time because he would lose his job and his visitation rights with his child.  After many court appearances we came up with a plan to provide 500 pre-made meals to be distributed by my client to homeless shelters in the metropolitan area.  My client would do this in exchanged for probation without jail time.  We were successful.
  6. I did this: My client, age 19, was charged with sexual assault of a minor.  We successfully resolved this charge in the County Court of Nassau County.  We showed that the young lady told my client that she was 19.  She came by the Long Island Railroad to my client’s home to “smoke weed”.  My client denied any sexual contact and that the young lady filed a police complaint only after her father forced her to do so.  The young lady was scared of her father and when he found out that she had gone to Long Island she panicked and created the story about being sexually abused.  Her father made her go to the hospital on the day of this event and the hospital staff found not evidence of sexual contact between my client and the young lady.
