COMMON NASSAU COUNTY TRAFFIC COURT MISTAKES

It’s unfortunate, but if you are not aware of the following mistakes, these can cost you a great deal of money in fines, DMV points and an increase in your insurance rates.  If it’s not your first offense, mishandling a moving violation could result in your license being suspended.  In the worst possible scenario, a mistake when getting pulled over can be deadly

FIRST:  DON’T ARGUE WITH THE POLICE OFFICER. Doing so can increase the number of ticket the officer will write and can even lead to your arrest.  Always provide the information which the officer requests.  Tell the police officer that you are reaching into your glove box to retrieve your documentation.  Keep your hands visible.

SECOND:  DON’T GIVE THE POLICE OFFICER ANY MORE INFORMATION THAN YOU HAVE TO.  Many of us have responded to the stress of being pulled over by overly talking to the officer.  Simply put, we talk too much and give the officer way too much information.  This can come back to bite us. If your rambling includes any sort of an apology for whatever the officer is charging you with, it can be used against you later in court.  Many people don’t realize that the only information they must divulge is your name, proof of insurance, driver’s license and proof of vehicle registration. If the officer asks for more information than that, such as an explanation, you can politely tell the officer you understand that you have the right to not answer their questions.

THIRD: DON’T MAKE ANY SUDDEN MOVEMENTS IF YOU’RE PULLED OVER.  This one is critical to your life.  If a police officer pulls you over, do not make any sudden movements.  You may see it as just a traffic stop, but police officers are trained to be exceedingly careful when pulling someone over. To the officer, you could be someone who has an outstanding warrant or who has stolen the vehicle you were pulled over in, or an individual who may behave desperately in an effort to escape.  If you move too quickly when the officer walks up, they are likely to think you are reaching for a weapon.  To prevent this, move slowly. If you need to reach into your glove box,  let the officer know what you are doing and wait for acknowledgment to do so.  Then move slowly, showing your hands at all times.
